Welcome to Emegatronic. These Terms and Conditions (“Terms”) govern your use of our website, products, and services. By accessing or purchasing from us, you agree to be bound by the following:
1. Use of Services
By using our platform, you represent that you are at least the age of majority in your place of residence. You agree not to use our products for any illegal or unauthorized purpose, including the violation of intellectual property laws.
2. Products & Pricing
Accuracy: We strive for precision, but we do not warrant that product descriptions or prices are error-free.
Availability: We reserve the right to limit the sales of our products to any person, geographic region, or jurisdiction.
Price Changes: Prices for our products are subject to change without notice.
3. Billing & Account Information
You agree to provide current, complete, and accurate purchase and account information. We reserve the right to refuse any order you place with us. In the event that we make a change to or cancel an order, we will attempt to notify you via the email provided.
4. Intellectual Property
All content included on this site—such as text, graphics, logos, and software—is the property of Emegatronic and protected by international copyright laws. You may not reproduce, duplicate, or exploit any portion of the Service without express written permission from us.
5. Returns & Refunds
Our return policy is governed by our Return Guidelines. Generally:
Items must be returned within 30 days of purchase.
Products must be in original packaging and “as-new” condition.
Digital downloads or customized “Emegatronic” hardware may be non-refundable.
6. Limitation of Liability
In no case shall Emegatronic, our directors, or employees be liable for any injury, loss, claim, or any direct/indirect damages of any kind—including lost profits or lost data—arising from your use of any of our services or products.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Emegatronic is headquartered, without regard to its conflict of law provisions.
8. Changes to Terms
We reserve the right to update, change, or replace any part of these Terms by posting updates to our website. It is your responsibility to check this page periodically for changes.
9. Abandoned Property & Storage Policy
Emegatronic values the space and resources required to service your engines and vehicles. To maintain operational efficiency, the following policy applies to all property left on our premises:
Inactivity Period: If a customer leaves an engine, vehicle, or specialized component at our facility for a period of 18 consecutive months without:
Providing a required down payment or settling outstanding invoices, OR
Maintaining documented follow-up/communication regarding the status of the project.
Right to Dispose: After this 18-month period, the property will be deemed “Abandoned.” Emegatronic reserves the legal right to seize, sell, or junk the property at our discretion to recover storage costs and clear facility space.
Final Notice: We will attempt to contact the owner via the last known email address or phone number 30 days prior to disposal. Failure to respond or clear the balance within that window will result in the immediate forfeiture of the property.
Liability: Emegatronic shall not be held liable for any loss of value or property once the 18-month abandonment threshold has been reached.
10. Unattended Drop-offs & Driveway Liability
Emegatronic maintains a strict protocol for receiving vehicles and equipment.
Assumption of Risk: We are not responsible for any damage, theft, vandalism, or towing costs associated with vehicles or engines left in our facility driveway, parking lot, or outside our secured gates without prior authorization.
Secured Check-in Required: A vehicle or engine is only considered “in our care” once it has been officially checked in by an Emegatronic staff member and a work order has been signed.
Damage Outside Hours: If you choose to leave a vehicle or engine on our premises outside of our standard operating hours or without our direct supervision, you do so entirely at your own risk.
